SIMA Status - Certain Stainless Steel Round Bar & Carbon Steel Welded Pipe 

 

Certain Carbon Steel Welded Pipe

On September 22, 2004, the Canadian International Trade Tribunal initiated an expiry review of its order made on June 5, 2000 in Inquiry No. RR-99-004, concerning certain carbon steel welded pipe originating in or exported from Korea. As a result, the president of the Canada Border Services Agency (CBSA) initiated an investigation on September 23, 2004, to determine whether the expiry of the order is likely to result in the continuation or resumption of dumping of the goods.

The investigation has now been completed and today the president of the CBSA has determined that the expiry of the order is likely to result in the continuation or resumption of dumping of the goods from Korea.

A Statement of Reasons that contains additional details concerning the determination made by the President will be issued with fifteen days. The Statement of Reasons will be posted on the CBSA Web site at:

The Tribunal will now conduct an inquiry to determine whether the continued or resumed dumping is likely to result in injury or retardation to Canadian industry, and will make an order by June 3, 2005.

(Canadian International Trade Tribunal)

On November 29, 2004, the Canadian International Trade Tribunal issued a notice of expiry seeking submissions on whether the October 27, 2000, finding concerning certain stainless steel round bar originating in or exported from Brazil and India should be reviewed. An expiry review was requested. The Canadian International Trade Tribunal is not satisfied that an expiry review is warranted and has therefore decided not to initiate an expiry review.

The Canadian International Trade Tribunal has conducted an interim review of its finding made on October 27, 2000, in Inquiry No. NQ-2000-002, concerning the dumping in Canada of certain stainless steel round bar originating in or exported from Brazil and the subsidizing of certain stainless steel round bar originating in or exported from Brazil and India. The Tribunal has also conducted an interim review of its order made on September 3, 2003, in Expiry Review Nos. RR-2002-003 and RR-2002-004 continuing, with amendment, its finding made on September 4, 1998, in Inquiry No. NQ-98-001 and its finding made on June 18, 1999, in Inquiry No. NQ-98-003, concerning the dumping in Canada of certain stainless steel round bar originating in or exported from Germany, France, India, Italy, Japan, Spain, Sweden, Chinese Taipei, the United Kingdom and Korea.

The Canadian International Trade Tribunal has rescinded the finding made on October 27, 2000. The Canadian International Trade Tribunal has also rescinded the order made on September 3, 2003. The statement of reasons will be issued within 15 days.
